General Terms & Conditions (GTC)

1. Scope of application

These General Terms and Conditions (hereinafter referred to as GTC) govern the relationship between the legal entity group of SmartBeauty (hereinafter referred to as "SmartBeauty") and the customer (hereinafter referred to as "Customer").


2. Services 

SmartBeauty provides non-invasive beauty treatments as a service. An overview of our treatment can be found here: https://www.smartbeauty.ch/treatments.

Services are subject to change.

As required by law, the treatments are carried out under specialist care, the duration of treatment is indicated in each individual treatment page. The treatment time begins at the agreed time. An extension of the booked treatment is only possible spontaneously if other appointments are not affected.


3. Appointments 

Registrations for appointments are binding. If the customer is unable to make an appointment, we ask you to cancel at least 48 hours in advance by phone or in writing (letter or email). Over the weekend within 72 hours. If the cancellation is delayed or not made in time, the respective booked treatment will be charged in full. 


If Smart Beauty is not able to carry out an appointment, Smart Beauty is entitled to postpone the appointment at short notice or withdraw from the contract. Smart Beauty makes every effort to inform the customer immediately, provided that the stored address and contact details enable timely contact.


In case of late arrival, there is a right to treatment only for the remaining time of the originally agreed treatment period. Smart Beauty is also entitled to charge the full treatment time. 


4. Pricing 

The prices are subject to change without prior notice. Unless otherwise agreed, the current prices at the time of treatment apply. These can be found on our homepage.


5. Payment

5.1 General

The treatment costs have to be paid before (online) or after completion of the treatment. You have the option to pay with debit or credit cards. Cash is not possible. If you agree to pay in full any fees or other transaction costs that may be incurred when transferring money to our bank account. Payments must be made in Swiss francs (CHF).


5.2 Payment in instalments via Heidi Pay

It is possible to pay via instalments up to 12 months under given conditions via the third-party provider Heidi Pay Switzerland AG at rue du Nant 8, 1207 Geneva, Switzerland. This instalment payment is a payment on account with an instalment option. This option is not valid for single treatments 


By paying in instalments, you agree that we assign our claims against you to Heidi Pay. The Terms and Conditions of Heidi Pay must be read and accepted before you decide to pay via installments . Only Heidi Pay is responsible for questions regarding the invoice and all other questions related to the payment. SmartBeauty offers customers 0% financing solution which means no interest on payment in instalments. This applies to all our treatments. Payments in instalment are starting from 66 CHF, rounder. The duration is up to 12 months. Even if you pay in installments via heidipay, services can be stopped with no prior notice if payments are not made on time.


6. Liability

The customer must notify us of obvious treatment defects in writing within 3 calendar days after he has been able to identify the defect. Otherwise, warranty rights are excluded. Further guarantees and guarantees, also with regard to the compatibility and success of treatment methods and products used, are not given.


The liability of SmartBeauty and its vicarious agents is limited to gross negligence and intentional action. The above limitations of liability do not apply to the culpable injury to life, body and health, and to the nature of the product and fraudulently concealed defects. In the event of a breach of essential contractual obligations, any claims for damages are limited to typical and foreseeable damages. Liability under the Product Liability Act remains unaffected.


Claims for damages against SmartBeauty expire at the end of three months after the contractually provided termination of the treatment, unless the claims are asserted within this period. SmartBeauty cannot be held liable for damages caused by incorrect information and/or omission of essential information by the customer.


7. Warranty

Within the framework of facial and body treatments, methods and products appropriate to the needs are used. A guarantee regarding compatibility and success cannot be given. This applies in particular if questions in the preliminary discussion on the part of the customer were not answered sufficiently or truthfully. Products can only be taken back if they show damage.


8. Customer information

Each treatment has a dedicated explanation that can be found in our website. Each page contains information about how Smart Beauty treatments works, what are the contraindications, risks and side effects, to whom is not recommended, and post treatment care. 


When doing a treatment, the customer confirms that has been informed in detail about the type, procedure, expected result as well as risks and side effects of the planned treatment in a personal consultation. Customer understands the explanation and was able to ask about all the details and uncertainties. Customer is aware that the Beauty Specialist acts to the best of her knowledge and will, but cannot guarantee success, as results may vary from person to person.. At the time of the treatment, customer agrees that is aware of the risks and contraindications and gives the consent to be treated.



9. Vouchers

Vouchers can only be used to pay for treatments that are offered at the time of redemption and during opening hours. Our offered vouchers for treatments are valid according to their defined duration. The voucher redemption must take place within the voucher validity. After this period, an extension is no longer possible.


The vouchers expire no later than 12 months after their issue, unless otherwise stated. The vouchers are personal and non-transferable. In case of loss or theft, the voucher will not be replaced.


10. Membership

Membership can only be used for the specified services / treatments. A settlement with other services / treatments is not possible. Membership are personal and cannot be transferred. Memberships expire no later than 12 months after issue. The refund of paid membership is not possible.


11. Data privacy

In principle, your personal data will be treated confidentially and will be used and processed exclusively within the framework of the applicable data protection laws.

The customer agrees that his personal data may be used for advertising for his own and third-party purposes (e.g. delivery of a customer newsletter and participation in his own competitions). The customer can prohibit the processing of personal data at any time without giving reasons and revoke the consent given for the future. 12. Release from medical professional secrecy

For the execution of the treatments and operations, Smart Beauty is dependent on processing health information of the customers, which may be subject to professional secrecy (Art. 321 StGB). The customer expressly releases the employees of SmartBeauty, if they are subject to professional secrecy, from professional secrecy with regard to all information and documents that he makes available to SmartBeauty

The customer agrees that

  • Smart Beauty forwards data required for invoicing and collection to the (name/address clearing house) or to its collection agency (name/address of the collection cooperation partner of the clearing house),
  • in the event of a persistent delay in payment, can provide the debt collection office with the information necessary for debt collection and
  • Smart Beauty can provide the competent court with the necessary information for the enforcement of the fee claim.


13. Self-pay services

All services of Smart Beauty are excluded from cost sharing by the health insurance companies. All services are self-paying services


14. Final provisions, place of jurisdiction and applicable law

Should a provision be or become invalid, this shall not affect the validity of all other provisions or agreements.

The court in Zurich is responsible for disputes. Swiss law applies.


The present GTC are valid from 01.01.2023
